Lymia
These General Terms of Use (hereinafter referred to as the "GTU") are proposed by the company Neil, a simplified joint-stock company with a share capital of 10,000 euros, registered with the Nanterre Trade and Companies Register under number 844 410 878, with its registered office located at 14, avenue André Chénier, Bois-Colombes (92270), hereinafter referred to as "Neil."
Neil is the owner and publisher of this application, Lymia (hereinafter the "Application").
APPLICATION OF THE GTU
These GTU aim to define all the conditions under which Neil allows users to use the present Application (hereinafter the "Users").
Every User declares to have read and accepted these GTU before any use of the Application. In the event that the User disagrees with one or more of the provisions of these GTU, they are requested not to use the Application.
ACCESS TO THE APPLICATION
Before any use of the Application, the User must ensure that they have the technical and computer means allowing them to use the Application, ensuring in particular that the computer configuration of their mobile terminal is in good condition and free of viruses.
Neil implements all measures to ensure the User's access to the Application under optimal conditions, 24/7. However, Neil cannot be held responsible in any case for the unavailability of the Application due to internet failure, bugs, or malfunctions that make access to the Application impossible.
Access to the Application may also be temporarily interrupted for maintenance operations.
USER ACCOUNT
To use the Application, the User must first create a user account on the Application. Where applicable, this user account may be created by an administrator designated within their company or directly by Neil.
It is the responsibility of the User to maintain the confidentiality and security of their login credentials for the Application.
The User must immediately inform Neil of any unauthorized use of their credentials. Neil cannot be held responsible for any loss or damage resulting from the User's failure or gross negligence in protecting their credentials.
USER OBLIGATIONS
The User agrees to comply with all the provisions of these GTU.
In this respect, the User undertakes to refrain from:
Using the Application in any illegal manner, for any illegal purpose, or in any manner incompatible with these GTU, Selling, copying, reproducing, renting, lending, distributing, transferring, or sublicensing all or part of the content appearing on the Application or decompiling, extracting, disassembling, modifying, displaying in a form readable by the User, attempting to discover any source code, or using any software activating or comprising all or part of the Application; Attempting to gain unauthorized access to the Application's computer system or engaging in any activity that disrupts, diminishes the quality, interferes with the performance, or impairs the functionality of the Application, Using the Application for abusive purposes by deliberately introducing viruses or any other malicious programs and attempting to access the Application unauthorized. Infringing Neil's intellectual property rights.
PERSONAL DATA
The User is informed that Neil processes personal data belonging to them through the Application. The processing of personal data by Neil is more fully detailed in its privacy policy. [ZB1]
In accordance with the applicable regulations on the protection of personal data, the User has the right to object, access, limit, rectify, port, and delete their personal data, as well as the right to object for legitimate reasons and to withdraw their consent by contacting Neil at the following address: legal@lymia.eu
LIABILITY
Neil makes every effort to guarantee uninterrupted access to the Application but cannot be held liable in any case if, due to unavailability linked to communication network failures or for any other reason beyond its control, the User cannot use the Application.
In the context of merely providing access to the Application, Neil acts solely as a technical service provider and cannot be held liable for any damage or harm not directly caused by Neil.
Neil cannot be held responsible for the non-performance of any of its contractual obligations due to the occurrence of a force majeure event.
INTELLECTUAL PROPERTY
The Application as well as all its elements and contents are protected by copyright, trademark law, design and model law, and/or all other intellectual property rights. All of these rights are reserved worldwide.
No title or right to any element or software will be obtained by downloading or copying elements of the Application. The User is expressly prohibited from reproducing, publishing, editing, transmitting, distributing, displaying, removing, deleting this Application and the elements and software it contains, nor modifying it or carrying out any work based on these protected elements.
The name and trademark Lymia, logos, designs and models, stylized letters, figurative trademarks, and all signs represented on this Application are and will remain the exclusive property of Neil. Any use by the User of the aforementioned elements, trade names, trademarks, and distinctive signs belonging to Neil is strictly prohibited unless expressly and priorly agreed by Neil.
CUSTOMER SERVICE
For any request for information, clarification, or complaint, the User must contact Neil's customer service first, to allow them to attempt to find a solution to the problem.
Neil's support service is available on business days from Monday to Friday from 9:30 a.m. to 12 p.m. and from 2 p.m. to 6 p.m. via the email address support@lymia.eu
The User acknowledges, however, that Neil can only process complaints related to the use of the Application.
DISPUTES / COMPLAINTS
In the event of a dispute that may arise in connection with the interpretation and/or execution of these GTU, the User is asked to contact their company in the first place, which will then contact Neil to resolve the dispute.
In the event of failure of this mediation procedure or if the User wishes to bring an action before a court, any dispute will be settled before the competent courts.
